Terms of Service for Sling

Welcome to Sling! These Terms of Service ("Terms") govern your use of the Sling app, website, and services (collectively, the "Service"), operated by Sling Inc. ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms, which establish a contractual relationship between you and Sling Inc. If you do not agree to these Terms, you may not access or use the Service.

1. Use of the Service

Sling provides a platform for influencers to connect with brands and secure brand deals while allowing for the analysis of social data to improve their reach and effectiveness. By using the Service, you represent and warrant that you are an influencer or a brand representative and that all information you provide is accurate and true.

2. Account Registration

• A. Account Creation

• To access certain features of the Service, you must register an account. You agree to provide truthful and accurate information during the registration process and to keep this information up to date. Each account must represent a real person or a legally recognized entity. The use of fake or fraudulent accounts is strictly prohibited.

• B. Application Process

• Access to Sling's services requires an application process. This process is designed to ensure that users meet certain criteria relevant to the platform's goals and community standards. By applying, you acknowledge that not all applications will be approved. Sling Inc. reserves the right, at its sole discretion, to accept or reject any application for any reason, without explanation.

• C. Membership Criteria

• Sling Inc. may establish and modify membership criteria at its sole discretion. Criteria may include but are not limited to, the type of content created by the influencer, the size and engagement level of their audience, and their compatibility with potential brands on the platform. Meeting these criteria at the time of application does not guarantee approval or continued access to the Service.

• D. Termination of Access

• Sling Inc. reserves the right, at its sole discretion, to terminate or suspend any user's access to the Service at any time, for any reason, including but not limited to breaches of these Terms, actions that may harm or bring into disrepute the reputation of Sling or any of its users or partners, or for no reason at all, with or without notice. This includes the right to remove or disable access to any account that is found to be engaging in fraudulent, abusive, unethical, or illegal activity, or any activity that violates our community standards.

• E. No Right to Appeal

• Decisions regarding application approvals, rejections, and terminations are at the sole discretion of Sling Inc. and are final. Users may not appeal or challenge these decisions.

• F. Responsibility for Content

• Users are solely responsible for their content on the platform, including but not limited to images, text, information, and all other forms of data. Sling Inc. is not liable for any claims related to the content or actions of its users but reserves the right to take action against users who violate these Terms or the platform's community standards.

• G. Changes to Membership Policy

• Sling Inc. reserves the right to modify its application process, membership criteria, and terms of access at any time, without prior notice. Changes will be effective immediately upon posting to the platform or notifying users via other means.

3. Data Usage and Privacy

• A. Collection and Use of Data

• By using Sling, you consent to the collection, storage, and use of personal data provided by you and your social media accounts. This includes but is not limited to demographic information, contact details, and any content you create or share on Sling. We use this data to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, such as to send you email messages and push notifications.

• B. Data Sharing and Disclosure

• We may share your data with third-party business partners, vendors, and consultants who perform services on our behalf or who help us provide our Services, under confidentiality agreements. This may include sharing information as necessary to process payments, conduct audits, perform analytics, maintain our database, and for marketing and advertising purposes.

• You have the option to share your data with selected brands through the platform. However, we reserve the right to use, share, and disclose your data collected through Sling to third parties for our business purposes, including but not limited to, sharing data with brands, analytics, enhancement of our Service, marketing, and as legally required.

• C. Data Transfer in Business Transfers

• In the event that Sling Inc. is involved in a merger, acquisition, sale of assets, or bankruptcy, your data may be transferred as part of that transaction. We will provide notice if your data is transferred and becomes subject to a different privacy policy.

• D. User Control and Access

• You have the right to access, update, and correct inaccuracies in your personal information in our custody and control, subject to certain exceptions prescribed by law. You may request access, updating, and corrections of inaccuracies in other personal information we have in our custody or control by emailing or writing to us at the contact information set out below.

• E. Analytics and Tracking Technologies

• We use various technologies to collect data about your use of our Service, including cookies and web beacons. This data is used to understand user behavior, preferences, and to improve user experience. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our Service.

4. Restrictions

• Users of the Service are prohibited from:

• Creating or using fake accounts.

• Extracting, copying, or transferring any data from the Service, including but not limited to brand data and contacts.

• Sharing any brand contacts or data with third parties without explicit permission from the brand.

5. Intellectual Property

All rights, title, and interest in and to the Service (excluding content provided by users) are and will remain the exclusive property of Sling Inc. and its licensors.

6. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

7. Indemnification

You agree to defend, indemnify, and hold harmless Sling Inc., its officers, directors, employees, and agents, from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of and access to the Service, or from or in connection with your breach of these Terms.

8. Limitation of Liability

Sling Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of, or inability to access or use, the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Sling Inc. is registered, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
